Terms of Use
Shadow Swings is published by Hackem Software, Canada ("we", "us"). By downloading or using the app you agree to these terms. If you do not agree, do not use the app.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Shadow Swings on Apple-branded devices that you own or control, in accordance with the App Store Terms of Service and Apple's Licensed Application End User Licence Agreement.
You may not copy, sell, sublicense, rent or redistribute the app; reverse-engineer, decompile or disassemble it except to the extent that applicable law expressly permits; remove or alter any proprietary notice; or use the app in a way that breaks applicable law.
2. Free version and Shadow Swings Pro
The free version of the app includes Free Hitting, Shot Analysis and the ball-hit click, with unlimited swings on the day you install it, then a daily allowance of 30 swings and a total of 5 Shot Analysis replays.
Shadow Swings Pro removes those limits and adds racket-head speed on every swing with an all-time record, unlimited Shot Analysis replays, video sharing of replays, a recorded ball-hit sound pack and advanced click tuning. Pro is offered as either a one-time Lifetime purchase or an Annual subscription. Prices are shown in the app and vary by region; the amounts quoted on this website are in United States dollars and are indicative only.
We may change the features included in the free version or in Pro, or change prices, for future purchases. A Lifetime purchase you have already made will not be revoked because prices or tiers change.
3. Subscription terms, free trial and cancellation
- The Annual subscription is billed to your Apple Account at the price shown at the time of purchase, and renews automatically each year unless you cancel.
- The Annual subscription includes a 7-day free trial for eligible new subscribers. The trial converts into a paid year automatically unless you cancel at least 24 hours before the trial ends.
- Renewal is charged within 24 hours before the end of the current period. You can cancel at any time, but cancelling within the last 24 hours of a period does not stop that period's charge.
- Cancel in your Apple ID settings (Settings → your name → Subscriptions on iPhone), not in the app. We have no ability to cancel a subscription on your behalf.
- If you buy a subscription while a free trial is running, the remainder of the trial is forfeited.
- The Lifetime option is a single, non-recurring purchase. It is not a subscription and does not renew.
- Purchases are tied to your Apple Account and can be restored on your other devices using "Restore Purchases".
Payments and refunds are handled by Apple, not by us. Requests go through Apple at reportaproblem.apple.com and are decided under Apple's policies. We cannot issue, guarantee or overturn a refund.
4. Not medical, fitness or coaching advice
Shadow Swings is a training toy and a feedback tool. It is not a coach, a physiotherapist or a medical device, and nothing it shows you is medical, physiotherapy, fitness or professional coaching advice. Racket-head speed shown in the app is an estimate derived from your phone's motion sensors, not a measurement of a ball and not a calibrated instrument reading. Do not use it to make decisions about an injury, a training load or a rehabilitation programme.
If you have an injury, a heart condition, a joint problem or any other medical concern, talk to a qualified professional before swinging. Stop immediately if you feel pain.
5. Physical safety — read this one
You are swinging a hard object at speed while holding it in your hand. By using Shadow Swings you accept that risk and agree to take these precautions:
- Wear a wrist lanyard or a strap case. Full swings send phones flying.
- Clear a wide space. Keep away from people, pets, windows, screens, mirrors, lights and anything breakable — including the ceiling.
- Make sure your hands are dry and your grip is secure. Start slowly and build up.
- Do not use the app in a moving vehicle, near stairs or ledges, or anywhere a slip would be dangerous.
- Supervise anyone under 16 who uses it.
To the fullest extent permitted by law, we are not liable for any damage to your phone or to any other property, or for any injury to you or to anyone else, arising from a thrown, dropped or swung device, from a collision, or from any physical activity you undertake while using the app.
6. Disclaimer of warranties and limitation of liability
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or accurate in its swing detection or speed estimates.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the app is limited to the amount you actually paid for it in the twelve months before the claim arose. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or lost profits.
Some jurisdictions do not allow the exclusion of certain warranties or liabilities. Where that is the case, the exclusions above apply only to the extent permitted, and nothing in these terms limits any right you have under mandatory consumer protection law.
7. Intellectual property
Shadow Swings, its name, logo, icon, app design, sounds, code and this website are owned by Hackem Software and protected by copyright and trade-mark law. These terms grant you a licence to use the app, not any ownership of it. Recordings and videos you export from the app of your own swings are yours.
iPhone, App Store and Apple are trademarks of Apple Inc. We are not affiliated with, endorsed by or sponsored by Apple Inc., the ITF, the ATP, the WTA or any tennis governing body.
8. Apple as a third-party beneficiary
Apple is not a party to these terms and is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple is a third-party beneficiary of these terms and may enforce them against you.
9. Termination
Your licence ends if you stop using the app or if you breach these terms. You can end it at any time by deleting the app. Sections 4 through 7 survive termination.
10. Changes to these terms
We may update these terms. The current version always lives at this address, with the effective date at the top. Continuing to use the app after a change means you accept the updated terms.
11. Governing law and contact
These terms are governed by the laws of Canada, without regard to conflict-of-laws rules, and subject to any mandatory consumer protection law of the place where you live.
